Was “Mut’ah” forbidden in “Khaybar”?

Notice: Mut’ah means temporary marriage.

Questioner: Reza Taheri.

Hello.

I ask you to answer my questions with document. A friend of mine asked me questions, but because I didn’t have enough information I couldn’t answer them completely. Please send the response of these questions to my e-mail and put them on website.

One of his questions is that “It’s written in Shia books that in the battle of “Khaybar” Prophet [PBUH] forbade donkey meat and “Mut’ah”? Is this narrative authentic or not?

First response:

Narrative that your friend asked about is written in “Tahzib al-Istibsar” book written by late sheikh “Tusi”:

محمد بن يحيى عن أبي جعفر عن أبي الجوزا عن الحسين بن علوان عن عمرو بن خالد عن زيد بن علي عن آبائه عن علي عليهم السلام قال: حرم رسول الله صلى الله عليه وآله يوم خيبر لحوم الحمر الأهلية ونكاح المتعة

It’s been quoted from “Ali” [AS] who said: on the day of “Khaybar”, messenger of god [PBUH] forbade eating donkey meat and temporary marriage.

“Al-Tusi” – Tahzib al-Ahkam – vol. 7, p 252

The text of this narrative is unacceptable by Shia scholars; because this narrative was said because of “Taqiyyah” {taqiyyah, literally "prudence, fear, caution") is an Islamic term referring to precautionary dissimulation or denial of religious belief and practice in the face of persecution}; that’s why not of Shia scholars have given fatwas based on it.

After quoting this narrative, late sheikh “Tusi” says:

فان هذه الرواية وردت مورد التقية وعلى ما يذهب إليه مخالفوا الشيعة ، والعلم حاصل لكل من سمع الاخبار ان من دين أئمتنا عليهم السلام إباحة المتعة فلا يحتاج إلى الاطناب فيه . وإذا أراد الانسان ان يتزوج متعة فعليه بالعفائف منهن العارفات دون من لا معرفة لها منهن

This narrative has been said because of “Taqiyyah” and is based on the sect of Shia opponents. Those who hear Shia narratives will make sure that temporary marriage is permissible in Shia imams’ teachings; so, we don’t need long discussion in this regard. When someone wants to do temporary marriage, he should marry chaste women.

“al-Sheikh Tusi”- Tahzib al-Ahkam – vol. 7, p 252

He also says in “Al-Istibsar” book:

فَالْوَجْهُ فِي هَذِهِ الرِّوَايَةِ أَنْ نَحْمِلَهَا عَلَى التَّقِيَّةِ لِأَنَّهَا مُوَافِقَةٌ لِمَذَاهِبِ الْعَامَّةِ وَ الْأَخْبَارُ الْأَوَّلَةُ مُوَافِقَةٌ لِظَاهِرِ الْكِتَابِ وَ إِجْمَاعُ الْفِرْقَةِ الْمُحِقَّةِ عَلَى مُوجَبِهَا فَيَجِبُ أَنْ يَكُونَ الْعَمَلُ بِهَا دُونَ هَذِهِ الرِّوَايَةِ الشَّاذَّةِ

We say that this narrative was said because of “Taqiyyah”; because it agrees with Sunni sects. Narratives were quoted before this narrative that agree with the text of Quran and the consensus of Shia sect is based on these narratives. So, it’s obligatory to us practicing those narratives not this rare narrative {one and against the principle}.

“Al-Sheikh Tusi”- al-Istibsar, vol. 3, p 142

After quoting this narrative, late sheikh “al-Hurr Ameli” says:

أقول : حملت الشيخ وغيره على التقية - يعني في الرواية - لان إباحة المتعة من ضروريات مذهب الإمامية ، وتقدم ما يدل على ذلك، ويأتي ما يدل عليه ...

I say: sheikh and others have said that imam has done “Taqiyyah” and said this narrative, because this fact that “Mut’ah” is halal is amongst the necessities of Shia sect and narratives that imply this issue, were already said and I’ll say reasons showing that temporary marriage is hallal. …

Second response:

Assuming that document of this narrative is authentic and that imam didn’t do “Taqiyyah” saying this narrative; because text of narrative agrees with Sunni narratives and is against Shia authentic narratives and Shia belief, it has no value for us and unacceptable.
